The correspondence between the two lists is fairly good: the same six countries lead the way (the three Nordic countries, Spain, the Netherlands, and the United Kingdom) whereas the same three countries close the list (Portugal, France, and Greece). It is not an easy task to explain convincingly the roots of these differentiated performances. Beyond sheer figures, Luxembourg is known for instance for transposing legislation slowly but well. Legal cultures and traditions are not the same across the European Union; laws do not have the same statute everywhere; various national, regional and local administrations work differently and have different cultures. In a country like France, where many legal texts exist, there are more risks to have an absolute number of them against Community law.*

An analysis of transposition by category can also be very instructive. Since 1997, twelve sectors mainly have had occasional or lasting transposition problems. Each of them is presented below. Contrary to the case of countries, the Scoreboard does not always provide a figure for each sector and we omit here sectors that have never been problematic or for which we do not have at least two figures. Differences between sectors with regard to the transposition of single market directives are highly contrasted. When we look at the whole period 1997–2000, we see that two sectors (phytosanitary checks and food legislation), even if they had a slight initial problem, overperformed the general average. Three sectors (chemical products, environment, and veterinary checks) only underperformed the global average by a small margin. Among these categories, the case of environment is particular: whereas the initial record was very poor, things have improved considerably and, since November 1999, global rates have been overperformed. The seven remaining sectors have been the most problematic ones. As in the case of countries, we can adopt two possible rankings:
